Solar panels can create a Utah closing delay even when the seller’s main mortgage payoff is straightforward. A financed system, equipment lease or power purchase agreement may introduce separate payment obligations, transfer requirements and recorded filings that the buyer’s lender must evaluate before funding.

Identify the agreement before ordering a payoff

Ask the seller for the complete solar contract, recent statement and financing information early in the purchase process. Determine whether the system is owned outright, financed, leased or governed by a power purchase agreement.

A UCC-1 financing statement gives notice of a claimed security interest. A fixture filing may appear in county real-property records, while other filings may be found through a state filing system. Its presence does not, by itself, explain the scope of the creditor’s rights or the lender’s required remedy.

Have the title company identify relevant filings and have underwriting review the underlying agreement. Do not assume that the panels add unrestricted appraisal value when another party owns them.

Choose the lender-approved resolution

The correct solution depends on the existing agreement and the new mortgage’s requirements.

ResolutionWhat must be established
Seller payoffAccurate payoff amount and required release documents
Buyer assumptionProvider approval and lender acceptance of the obligation
SubordinationAcceptable priority arrangement and executed documents
Filing termination or releaseCorrect filing references and recording procedure

A UCC-3 can be used for several filing actions, including termination, but the title company must determine the appropriate documents for the actual records. A payoff receipt alone may not satisfy closing requirements.

If the buyer assumes solar payments, underwriting may need to include them in qualification. The Consumer Financial Protection Bureau provides useful mortgage comparison resources. Buyers using assistance should also have their participating lender confirm compatibility with Utah Housing Corporation requirements.

Work backward from the contract deadline

Request transfer applications, payoff statements and release instructions well before settlement. Solar providers can have processing queues, payoff expiration dates and requirements that differ from the mortgage lender’s timetable.

Use our REPC deadline guide to coordinate unresolved solar issues with financing protections. Add buyer-paid transfer or recording charges to the closing cost estimator.

Before signing, reconcile the settlement statement with the agreed allocation of solar costs. Confirm who sends payoff funds, who files releases and how completion will be documented. That paper trail matters when the home is later refinanced or sold.

Editorial Methodology & Primary Sources

Verification date: Not recorded; check the primary source and lender timestamp before relying on an estimate.

Rate comparisons use participating lender feeds, not a whole-market survey or guaranteed offers. Freddie Mac PMMS is a market benchmark, not a personalized quote. Calculator models rely on published regulatory formulas and disclosed assumptions rather than fabricated first-person loan testing.

Monthly principal and interest use the amortization formula P × r / (1 − (1 + r)−n), where r is the monthly note rate and n is the number of payments; at zero interest use P / n. PITI adds monthly property taxes and homeowners insurance; PMI is separate. APR includes applicable finance charges under Regulation Z and is not the note rate used for payments. Compare lender Loan Estimates for actual APR and fees.

The payment snapshot uses illustrative annual taxes of 1% of home price, $1,200 insurance and 0.5% PMI below 20% down, not verified local quotes. Other calculators disclose their inputs and assumptions. Published guidance and lender feeds may change independently; confirm current program rules, taxes and offers before a decision.
